2. Description of Services

FindNCall provides data enrichment services including but not limited to skip tracing, phone verification, email verification, business enrichment, and contact data lookup.

3. User Responsibilities and Data Usage

You are solely responsible for how you use the data obtained through our Services.

• You will use the data only for lawful purposes and in compliance with all applicable laws.
• You will comply with the TCPA, DNC regulations, CAN-SPAM Act, and other applicable laws.
• You will not use the data for any illegal, fraudulent, harassing, or harmful purposes.
• You are responsible for obtaining any necessary consents before contacting individuals.
• You will not resell or redistribute data without express written permission.

4. Limitation of Liability

FindNCall provides data “as is” and makes no warranties regarding accuracy, completeness, or fitness for any particular purpose.

• FindNCall shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages.
• FindNCall is not responsible for any actions you take based on the data provided.
• You agree to indemnify and hold harmless FindNCall from any claims arising from your use of the Services.
• Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.

5. Data Ownership and Rights

• FindNCall retains ownership of all data, databases, algorithms, and intellectual property.
• Data you submit may be retained, processed, and used to improve our Services.
• FindNCall reserves the right to use aggregated, anonymized data for analytics and research.

6. Account and API Usage

• Do not share your API keys or account access with unauthorized parties.
• Notify us immediately of any unauthorized use of your account.
• Use the API in accordance with our rate limits and usage guidelines.
• Do not attempt to circumvent any security measures or access restrictions.

7. Payment and Credits

• Credits are non-refundable except as required by law.
• Subscription credits do not roll over unless otherwise specified.
• We reserve the right to modify pricing with reasonable notice.
• Failed lookups that return no results will not be charged.

8. Prohibited Uses

• Harass, stalk, or threaten any individual.
• Engage in fraud or identity theft.
• Violate any person's privacy rights.
• Send unsolicited communications in violation of applicable laws.
• Compile data for building competing services.
• Engage in any activity that could damage or impair our Services.

9. Termination

FindNCall reserves the right to suspend or terminate your access at any time, with or without cause.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use constitutes acceptance.

11. Governing Law

These Terms shall be governed by the laws of the United States. Disputes shall be resolved through binding arbitration.
